Trying to apply for husbands greencard i am a us citizen will the new waiver help us

My husband entered the US in 2006 without inspection we met each other in 2008 and got married in 2009 we now have a daughter and a baby on the way. We want to apply for his green card but ive heard that he can only qualify for the provisional waiver if we can prove that i would suffer extreme hardship and that it doesnt count i its just financially bit the thing is that i also have a prosthetic leg that even though does not prohibit me from working it does make it more difficult and more dangerous for me we just need some help to know i we have any possibilities or to not even bother
You have possibilities of having the I-601A application for provisional waiver approved on the basis of extreme hardship to you if the waiver is not granted. Although only U.S.C.I.S. can make a decision, the little that you have mentioned sounds fairly compelling. I suggest that you find an attorney competent in I-601A filings.
