In 2002 I was arrested in NY with penal code 220.03, but I pled guilty to NY penal code 240.20. is any waiver available in my situation or I don't need any waiver after all?, want to travel back home but want to be able to come back to my family without a problem.

Usually with 240.20 you do not need a waiver. However, there are different situations and you should speak with an Immigration attorney in private.
