I have been working on an H1 visa and have an approved I-140 with a priority date of March 2026. I was laid off on September 20th, 2024, so I am currently within the 60-day grace period. I am exploring the possibility of applying for Adjustment of Status to move forward the priority date under the following circumstances: My 13-year-old daughter is a U.S. citizen. I am divorced, and her mother has primary custody. If I have to return to my country of origin, I will be forced to live apart from my daughter, which would be an inhumane situation for a 13-year-old child. I am in a legal child custody agreement with my ex. Given the circumstances outlined above, what are my chances of advancing my priority date?

Hi there, unfortuantely there is no way to advance the priority date. There might be other options for you to remain lawful in the US while you wait for your priority date. We would need to speak with you in order to know more about your background.
