QUESTION

What are my options when my visa is expired?

Asked on Feb 23rd, 2012 on Immigration - Texas
More details to this question:
My visa expired some 16 years ago. I have been a good citizen in this country. I'm also 245i grandfathered. Employers are hard to find to petition. I have my dad and brother who are US citizens but are estrange to me due to the fact that they cause my immigration status to be a mess. I have a sister and nephew who live with me who are also US citizens. What other options do I have?

It matter in what way are you grandfathered by the 245i. You can also just file on the basis of whatever petition grandfathered you.

If you are grandfathered for section 245(i), you are still deportable. You should find a petitioner to file the labor certification as well as having your father file for you with a family-based petition. As an adult child of a US citizen, it will take several years for the priority date to be current.
