What are the requirements to get a green card?

More details to this question:
My fiance and I have been together for 11 years and we have 2 kids together. Can he apply for a green care after we get married? What the requirements?

You may apply for your husband's green card, however, if entered illegally then he may need to return to his home country to process the application. In addition, his particular history such as whether he was ever arrested or been convicted or previously deported may be issues whereby you will require an attorney.

A U.S. citizen spouse can apply for status for their non-U.S. citizen spouse based on marriage. Whether or not you are able to process your case inside the U.S. or in your home country to request lawful permanent residence status will be determined by whether or not there have been previous immigration violations, such as entering without any papers, or any criminal history of the non-U.S. spouse.

I recommend that you have a full consult with a competent immigration attorney to review your immigration history and eligibility. There are different options depending upon whether you are in or out of the US. He can sponsor you if you are married or engaged to enter the US. You cannot get a green card until after you are married.
