More details to this question:
My wife and I been married for two years now and august will make us 3 years. I got my green card through our marriage and in NY. I took my wife and my son outta NY and we move to another state but my wife is insecure and very controlling and itโs something I been battling with all the years we been together. She has made everyone including my family to stay away from me because of her attitude. I have a two years green card and awaiting my 10yrs. I am fed up as we have gone to many counseling and itโs not working. I want a divorce because this is affecting my mental health and she insults me and literally provokes me to the cord that some guys would beat on their wife if the were in my shoes. But am concerned if this will affect my immigration status. I need an advice and a lawyer.
Given the circumstances you may be a perfect candidate for VAWA. The violence against women's act, which also applies to men, allows a foreign national immigrant to acquire a green card without the participation of their spouse, if they are the victim of not only physical violence but emotional abuse and verbal abuse. You don't need physical abuse in order to qualify, because emotional and verbal abuse is sufficient. You should retain counsel to process your case from start to finish. Counsel in any state can assist you.
This is a question better addressed to an immigration lawyer given all of the changes that have taken place in the past 18 months in this country and the change in policy concerning your legal status.
