QUESTION

What can I do about my N400?

Asked on Sep 23rd, 2012 on Immigration - New York
More details to this question:
Got married in 07 with USC and got conditional green card. Then in 2008 had baby with different girl while I was married to USC then 2009 removed conditions then divorce in 2010. After that applied for N400 in 2012 and listed child 1 previously born in 2008 and 2nd born in 2011 with that same girl (not ex spouse) so at the interview they took my sworn statement with all this info. But in mean time not to forget my marriage was off course bonified with tons of documents evidence, so now it's under review they said also next day after interview case status change to scheduled for interview.

I think the question everyone has is why you stayed with this guy while he was potentially cheating on you? Was his ex already pregnant when you met him? Or did she get pregnant while you two were together? Did you disclose this on your 2009 application? Because, how it looks on the application is that he was with her the entire time you two were married since the next kid was born last year. There could be a perfectly good explanation, but it looks like, well, fraud. They are not great about keeping the website up to date, so don't worry too much about it. It is probably going through supervisor review. At this point there really isn't anything you can do. But if they deny it, you only have 30 days to appeal it. This is where you would submit any evidence to support your N-400.

There is nothing you can do at this point, except retain an immigration attorney who would know all the details of your case and be ready to intervene immediately if things turn ugly. Hopefully, your application will be approved, and all the worries will be for nothing. But, as the old adage goes, one should hope for the best - and prepare for the worst.

Your greencard application is likely under review. If a finding of potential marriage fraud is found you will want to retain an attorney to assist you.
