QUESTION

What can I do if the background check for I751 was delayed?

Asked on Jan 06th, 2013 on Immigration - California
More details to this question:
On September 2011, I applied for i751 and I did after that a fingerprint. On June 2012, I received a letter from VSC asking for more evidence and I did send it to them. From that time, I didn't get any answer from them. I called them and they send my letter saying they are going to do a background check and they ask for 90 days. After the 90 days, I called and they send my letter saying that my background has being delayed and they ask me for another 90.

So you just need to wait and follow up with them on a regular basis. There is nothing else you can do. Please let me know if you have any additional questions or how I can be of further assistance to you in this matter.

When my client gets tired of waiting, we file a lawsuit to compel action, and within 45-90 days, the case is over.

You need to wait the 90 days. If it takes a substantial amount of more time, then you can explore other options.

Delays happen. Just wait. However, if you are within 90 days of having 3 years of residency and are still married and living with your spouse, you can apply for naturalization.
