QUESTION

What do I do to help my father become a US citizen?

Asked on Feb 28th, 2013 on Immigration - New Jersey
More details to this question:
I was born here and Iโ€™m about to turn 21. My father came here before and lived for 8 years. On 2007, he went back to Brazil and on 2008. He tried to come back and when he got here, the immigration told him last time he came he stayed over the time his visa allowed him to and told him to try to come back again after 5 years, which has passed. I can get him his papers. Whatdo I need and how long does it take?

If he is no longer subject to the bar to reentry, you need to petition for him and it will take about 9-12 months for him to be eligible for an immigrant visa.

You can file an I-130 for him as an immediate relative. If he has not been outside the U.S. pursuant to the 3/10 year bar then you may be able to file for a waiver for him. We handle cases like this all of the time for our clients.
