A lawyer can assist with the alien relative petitions and the Consular processing to get your children here as soon as possible. Each lawyer will set his/her own price. Government filing fees and Consular fees also will apply.
Hello: *Consulate Processing* Consulate Processing must be completed. This allows the petition to first be sent to the National Visa Center, and then the appropriate documents and package to go to the U.S. Consulate or Embassy. If done correctly, you will be able to enter as a Lawful Permanent Resident and will be in the U.S. in less than one year. Of course the time might be a bit less or more depending on the backlog of the U.S. Consulate or Embassy and whether or not a Waiver of Inadmissibility is needed. Attorney Fees (Filing Fees and Costs not included) The total Attorney Fees will be $2,500.00 - my firm charges $1,250 additional for each child.
Consult with an immigration lawyer. Although many people think immigration law is about filing papers, it is much more complicated than that; one little mistake can cost money and time. You can petition for your children and the process is a little complicated.
Depending on many factors, they are either citizens or not. If it is the former, they can apply for their U.S. passports or you can file an I-130 form if the latter applies. You should provide specific and detailed facts to an immigration attorney to discover which one applies.
Depending upon the details, your children already may be U.S. citizens. There is no substitute for engaging an immigration attorney to carefully review all of the circumstances relating to you and your children in order to advise about their current status, their eligibilities, options and strategies. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.
You should first check if your children are already US citizens. Under certain circumstances that may be the case. If they are not, then you will have to file 3 I-130 visa petitions for them and then proceed at national visa center and finally the consulate.
Were the children born after you were already a US citizen? If so, it may be that they are already US citizens. If they were born before you became a US citizen, you will need to petition for them. Each child will need a separate petition. The form number is I-130 but there is additional supporting documentation you will need to provide.
To petition your children, you need to submit a petition on form I-130 for each child. The filing fee for each child is $420. There are additional costs when your children apply for their immigrant visas.
