What happens if we run out of time before the right forms come from the home country?

My husband and I got married while he was here on a valid H1B visa. It expired Nov 2nd and we have 90 days from then to get our paper work in. We are still waiting on a "long from" or unabridged birth certificate from South Africa and his parents have tried to get it over the course of 3 months and have been told to wait longer. We are running out of time . What is our next option?

Who told you that you have 90 days to get the forms in? I assume that you are an American citizen? And your husband entered the USA legally?
