Hi, Im Canadian, I have been here since I was 14. My parents never filed for me. I met someone we've known each other for 10 years and we've been married for almost 4 years he has not started the process to file for me. I'm now 27 and my husband had an affair and doesn't know if he wants to be with me anymore. What are my options staying here, divorced or staying here married?

If your husband does not file for you, you cannot remain in the US unless you have a different form of relief. If your husband divorces you, he can no longer file for you. If you have been the victim of physical or emotional abuse at the hands of your husband, you may be eligible to file a different application without him to get a green card.
