QUESTION

What Is My Status After marriage

Asked on Feb 13th, 2016 on Immigration - Florida
More details to this question:
I'm F1 student on CPT with work permit. Working right now based on my CPT program. I got married to a US citizen. I just received my new work-permit that is based on my marriage. Our case is still being processed by the immigration, only the work-permit was sent to me. What is my status as of right now ? Am I still a F1 student ? Which work-permit is valid the F1 based or the one based on marriage ? Can I work based only on the work-permit I got from my marriage ? What do I tell or show if I go to DMW and they ask "what is your status" what papers do I show ? If I drop out from university or pause due to lack of time do I become illegal ?

Marriage to a United States citizen conveys no status upon you. You continue to be in CPT status assuming you are maintaining said status. Otherwise, you are not in a valid nonimmigrant status. You may work on either work permit. You will be out of status if you drop out of school. You would not have a status at that point but you could advise the DMV that you are pending adjustment of status. You should take your EAD and all case related documents to the DMV.
