QUESTION

What is the best path for achieving social for my husband?

Asked on Jan 11th, 2013 on Immigration - Utah
More details to this question:
My husband and I have started the paperwork towards getting him a path to residency through petitioning an alien relative. We have sent in the Affidavit of Support or are currently in the process of sending them; however, we wanted to see if we could file for the Deferred Action of Childhood Arrivals as he was brought here when he was one year old, so that my husband doesn't have to leave the country. We wanted to know if this would complicate his case and if it would be a fast way to get a social security for him to do our taxes.

If he qualifies for the DACA, you can certainly apply for that.

If your husband is eligible for DACA, he should file it as that wil get him a social security and work permit. However, if you are a US citizen and your husband is able to prove that he entered US with a visa when he was brought to the US, you should file for his green card instead
