Hello,
Hope all is well.
I received my EAD in last April and now I am having a great opportunity which require to join the new company on their W2. Based on my personal research, it is risky to change the employment within 6 months of EAD issue date. Wondering about following:
a. What legal issue I may face by changing the employment as EAD is just 3 months old?
b. Will there be a chance for my Green Card to be declined due to this change?
c. Does the new company has to do anything to continue the EAD to GC process intact?
Also, while you replying these, if you can tell me the hourly consulting rate would be appreciated.
Thank you,
Trushant
Hi. This will depend on how you got the EAD. If it is employment based, you can still switch jobs, if the new company is taking over the sponsorship. However, this can only be done if it has been 6 months since the filing of the I-485 (not the EAD). The new job must be similar and there are specific rules for that. Feel free to email or call with more details. Harun@ksvisalaw.com
