Asked on Mar 27th, 2012 on Immigration - Texas
More details to this question:
My husband is 19 years old he came to the united states illegally when he was 14 years old. We just got married and we want to know how we can start his paper process so he is here legally so he doesn't have to go back to Guatemala. I can't lose him. We love each other so much.

If he entered the US unlawfully and is already over the age of 18, there is no way for him to legalize his status within the US under the current immigration laws. He would have to go back to his home country to consular process but departing the US will cause him to trigger an automatic 10 year bar to reentry, which can only be waived by a showing of extreme hardship to a US citizen spouse, which is fairly difficult to do in most cases.

You need a full consult with a competent immigration attorney to see if you can file for him in the US or abroad; if an extreme hardship waiver is needed; and if any other eligibility exists for him with other green card pathways. If you can't afford a consult, then call the local chapter of your state bar to find a pro bono attorney who can evaluate your case!

The process depends on the exact manner of entry, any family filings before April 30, 2001 and any immigration or criminal violations.
