QUESTION

What options do have if I received a Request For Evidence from USCIS?

Asked on Apr 11th, 2016 on Immigration - New Jersey
More details to this question:
I am an Indian student. I am currently on F1 Visa, just completed my master’s degree and am already working full time for an employer. I am on OPT which ends on May 2016. I was booked for DUI on February 2016. I applied for OPT STEM extension couple of days after that. I received a letter from USCIS today asking for the following documents. 1) A statement from the designated school official (DSO) attesting that you are in lawful F-1 status and that you have not violated your F1-Status. 2) A court Disposition of the arrest on February 14, 2016. My case is still not completed and I cannot get a disposition yet. USCIS letter said my last day to submit docs was on July 1.

You have to get an immigration attorney who understands criminal charges in the state of your residence. This case involves how federal law interconnects with the state law that results in a possible removal proceedings at the worst, or the processing may just be delayed by USCIS asking for an explanations through their "request for evidence" at its mildest.
