QUESTION

What should I do on my ex fiance K1 visa before it expires?

Asked on Apr 10th, 2014 on Immigration - California
More details to this question:
My now ex-fiance and I petitioned for a K1 and she received the visa in her passport. It expires in 5 weeks but she has decided that she cannot go through with it and does not intend traveling to the U.S.A. I have read online that I should inform USCIS office that approved visa, NVC and embassy where it was processed. Is it in any way detrimental to me if I do this shortly after the visa has expired? Or do I need to do it before the visa expires? Thanks.

A letter from you to CIS to notify them that you and your fiance no longer intend to commit to the relationship is sufficient. As the US citizen petitioner, you can withdraw from the petition at any time. CIS will immediately revoke the K-1 visa and she can no longer use it to enter the country. The decision is not with prejudice and, if in future, you both agree to renew the relationship, you may file another Form I-129 F fiance petition for her.

Because the visa expires in just 5 weeks, it's probably wise to just leave it alone in case she changes her mind. Once the visa expires by itself, you don't need to do anything else. Otherwise, you can contact the consulate to let them know that you are withdrawing your fiancee petition.
