QUESTION

What type of working visa would I apply for?

Asked on Jul 25th, 2016 on Immigration - Delaware
More details to this question:
I am a German citizen with children that are US citizens. I currently in the US visiting my children and girlfriend and was looking for jobs so I am able to stay here with my children and girlfriend. I found a job and I'm not sure which visa to apply for. Would I have to apply for the nonimmigrant visa or the immigrant one? Also, when I was looking things up online it says that in order to get certain visas I can't be in the country already. If the working visa wouldn't work out in my case, do you know of any visas or green cards I could apply for since I have children that are US citizens.

The fact that you have U.S. citizen children does create a path to lawful permanent residence unless one of your children is at least 21 years of age. There are a variety of nonimmigrant and immigrant works visas. Most work visas require an employer to sponsor you. The type of visa you should pursue will depend upon your education, experience, skills, and ultimate immigration goals. Some visas are limited to annual caps so they may not be available until fiscal year 2018. You do not necessarily need to leave the United States; you may be able to change your status if you entered on a visa rather than through the visa waiver program. I encourage you to consult an attorney.
