Once your divorce is final your partner can file a fiancé visa petition on your behalf. A fiancé visa will allow you to enter the United States with the intent to marry and seek permanent residence. You will need to marry within 90 days of entry. You can request employment authorization after entry. After you have married, you would petition for a green card.
