QUESTION

What will happen if I am already separated before my adjustment has been finalized?

More details to this question:
I am from England entered on K1 visa with full intentions of staying married. I did marry for love. A month after marriage things went wrong. Wife and mother in law threw me out after two months. We started my readjustment and I have my work visa (i795 approved). If my wife files for divorce what happens? What options do I have? I check online and my i485 still says initial review.

You will not be eligible for adjustment of status if you are no longer in a bona fide marital relationship.

If you can persuade the CIS that your marriage is bona fide, you could still get your green card. Hire an immigration lawyer to help you.

While DHS does not always follow the law, the law does allow you to finish adjustment even if divorce is pending.
