I entered into the US legally to attend college, took a semester off in my 3rd year back in 2011 because I was unable to afford it. ICEE then came knocking and I had to go to a deportation hearing. I was late for the hearing but tried making calls to let them know I was being late but couldn't get to the right person. Since then I've gotten married 2 years ago to my college girlfriend. We were together for 6 years prior to getting married. We have a 8 month old daughter together. I work and pay taxes, I support my family. Just wondering what would be the best option to remain here to be with and support my family?
The best option would probably be to seek legal assistance to file a request for a joint motion to ICE to have your case reopened. If such can be done and the immigration judge agrees, you would apply for adjustment of status to permanent residence assuming that your girlfriend is a US citizen. If she is not a US citizen, then your options become more limited and you should certainly consult with an immigration lawyer to go over your situation in depth before taking any action.
