QUESTION

When and what other forms do I need to file in conjunction with I-130?

Asked on Jan 16th, 2013 on Immigration - New York
More details to this question:
I passed the citizenship test at the end of 11/2012 and am waiting for the swearing in ceremony. I married my wife here in the U.S. during her second visit in three months with a B2 visa. When should I file form I-130? What other forms do I need to file? Anything we need to watch out for?

You should file the I-130 once you obtained your citizenship certificate since this would allow your wife to concurrently file an adjustment application which shortens processing times for her to obtain a green card. The manner of your wife's last entry can be grounds for concern at the interview. You should consult with an immigration attorney to assess the case before you file yourself.

You need to file the I-130 and the supporting documentation. IF you are not sure of what to submit you should consult with an immigration attorney.

Assuming she is eligible for adjustment of status, you will need to file the I-130, I-485, I-765, G-325as, and I-864.

You should always watch out for errors or problems, which is why hiring a lawyer is better than trying to do it yourself, and regretting it later.

You should file the I-130 and the I-485 as soon as you become a US citizen. There can be issues since she stayed on a tourist visa, however.
