QUESTION

When should I file form I-485?

Asked on Dec 11th, 2021 on Immigration - Colorado
More details to this question:
I am a Canadian citizen currently in the United States now married to a US citizen on a visa waiver free status up to six months. I plan on filing an adjust of status form I-485 so I can stay her and live with my wife but my six month deadline is ending soon. Would I have to file the I-485 form prior to my six month visa deadline or will filing shortly after the deadline effect my application or status?

If you had non-immigrant intent when you entered the United States and there are no other issues that would bar your admissibility, then you would be OK to move forward. You should contact immigration counsel to proceed. A Canadian visitor without visa may be petitioned by a US citizen spouse and file a green card application with the petition and not leave the US. Some of us take these cases on a flat fee, which is reasonable with no hidden costs.
