QUESTION

Where should we apply, my current residence or her residence?

Asked on Dec 22nd, 2016 on Immigration - California
More details to this question:
I just got married with my US citizen wife this month. We have been in relationship for 8 months so far. We plan on applying for my green card very soon. She is finishing her undergraduate degree in February. However, I have been pursuing my Master's degree in another state since late August. We have never lived together so far because we currently still go to schools in different states. Is it possible to apply for green card with our circumstance?

It's possible, but it's going to be complicated. You're going to have to show that the marriage is bona-fide and not just for immigration purposes and will have to show documentation of the bona-fide marriage. I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. (S)he would then be in a better position to analyze your case, advise you of your options and, if possible, make sure that the necessary paperwork and documentation is properly presented so as not to delay the process.
