QUESTION

Will a legal separation cause my wife a problem getting U.S. citizenship?

Asked on Feb 26th, 2013 on Immigration - Colorado
More details to this question:
Wife is a foreign citizen and just renewed her Green Card last fall. Was made aware that she could get dual citizenship. Decided not to do it then. Has been in the US for about 20 years. Now she would like to get dual citizenship; however, we are talking about separating and possibly divorcing. I would like things to be amicable. We have a teenage daughter. Will pursuing a legal separation or divorce impede her from getting the dual citizenship? She would like to stay in the country and I think it would be good for our daughter.

She can keep her permanent resident status even after divorce.  If she has been a permanent resident for at least five years, she can apply for citizenship even if the two of you divorce.
