Will a minor who overstayed a 30 Visa, affect a Fiancé Visa?

My Fiancé had a 15 year old who came to The United States in December on a 30 day Visa to visit her Uncle. After arriving, the Uncle asked to keep the boy here to give him a better opportunity at a future. How can we get him in a legal position? How may this event affect her chance at a Fiancé Visa?
