QUESTION
Will a minor who overstayed a 30 Visa, affect a Fiancé Visa?
Asked on Mar 10th, 2016 on Immigration - Kentucky
More details to this question:
My Fiancé had a 15 year old who came to The United States in December on a 30 day Visa to visit her Uncle. After arriving, the Uncle asked to keep the boy here to give him a better opportunity at a future. How can we get him in a legal position? How may this event affect her chance at a Fiancé Visa?

This situation will likely not impact her ability to immigrate through a fiancé visa petition. There are several options for her son to pursue residence each with its own positives and negatives. I would encourage you to consult an attorney to develop a strategy for handling both matters.
