QUESTION

Will a US citizen be convicted of visa fraud?

Asked on Feb 09th, 2013 on Immigration - Massachusetts
More details to this question:
If a US citizen marries someone from another country who was here on a tourist visa, knowing that it was illegal, will they be convicted if it was for love? Basically the US citizen was manipulated by the immigrant because the immigrant tricked her and only wanted the green card? When the citizen suspected this, she didn't want to marry the immigrant but he threatened her and manipulated her into marrying him. So will the US citizen be convicted for visa fraud even though she only married him out of love and fear?

Based on these facts, prosecutors would not be interested in a case like yours.  Generally, prosecutors like cases that involve serial offenders in theirs area--like citizens who routinely marry foreigners to get them a green card.
