QUESTION

Will my application be denied?

Asked on Dec 13th, 2012 on Immigration - Florida
More details to this question:
My boyfriend and I want to get married, I am worried that our petition for Alien Relative application will be denied. I was married before for 7 years and I applied and was approved for his permanent residency. We decided to divorce due to the relationship not working. Now I have a new boyfriend of almost a year now. We are happy together and plan to get married. I am worried that after we get married and I apply for his application they will deny it because of my last marriage. Both relationships were very real we lived our lives together in every way possible. But after 7 years the first one just didn't work out.

U.S.C.I.S. may look closer at your next petition for a husband to determine whether the marriage is bona fide. Petitioning for a second spouse, however, is not ground for denying the petition. At the time of interview for an adjustment of status in the States, you and your husband should have all the evidence of marriage relationship including lease or deed , bank accounts, job letters, photos, etc. If your husband is overseas and will be interviewed at an American consulate or embassy for the immigrant visa, he should bring in all the evidence at the time of interview over there. Many marriages don't work out, and marriages involving foreign nationals are no different.   The immigration service is primarily concerned with marriage fraud.  Since you were married for seven years before, the immigration service will not view your situation as one involving a serial applicant. This issue should not prevent your boyfriend (soon-to-be husband) from obtaining permanent resident status.
