Will my case be denied? Pembroke Pines, FL | 37 minutes ago Hello, I am an A1 visa holder and my husband applied for me to get permanent residence in the States. I had also applied for a travel document since I was scheduled to travel during the application process. I received my travel document as well as my employment authorization card. I traveled out of the country for a week and upon returning to the USA, I failed to present my travel document and instead I presented my A1 visa. I went to my interview this morning and the officer approved our I 130 application but says that the I 485 needs further review because I didn't present my travel document and it means that I abandoned my I 485 application. And that it might get denied. They sent us home saying we should expect a notice within 120 days. I am afraid that they might deny my case and I would have to start all over again. How big of an effect will that cause? Is that ground for denial? Everything else is fine except this issu

Your application for adjustment of status may be denied. You departed the United States while the application was pending and did not re-enter with advance parole. This can lead to a finding that you abandoned your application. If you are deemed to have abandoned your application, it will be denied. You may need to start the adjustment of status process from scratch. The issue you could potentially face starting anew is immigrant intent at the time of your last entry.
