QUESTION

Will my H1B application be considered by USCIS?

Asked on Apr 06th, 2013 on Immigration - Nevada
More details to this question:
My employer filed my H1B on April 5th 2013. Since the United States Citizenship and Immigration Services announced that they have reached the cap for this year and will accept application until April 5, I was wondering if my application will be considered or not. My H1 was filed on April 5 around 12 noon. Do they file it online or by mail?

There will be a lottery since they received too many. They will return those who lose the lottery or those that arrived too late.

If your petition was not received by USCIS by April 5, you will not be in the lottery.

Ask your employer. They can be filed either way.
