Will my husband be deported after an arrest for traffic violations?

More details to this question:
My husband was arrested on traffic violations but we can't bail him out because he has an immigration hold. He also has overstayed his visa by a month. Will they deport him?

He will probably be placed in removal (deportation) proceedings assuming he was admitted in the US w a temporary visitor visa (B-1/B-2). He may however request a custody determination such as a bond from the immigration court. Once the bond is posted he would be released by the ICE.

Your husband is deportable if he currently does not have immigration status but he may be eligible for relief from removal. It takes more information to determine such relief so that you should contact an experienced immigration attorney.

As a matter of law, the ICE may be in a position to deport your husband, who should retain an attorney to represent him at the deportation proceedings.

If he is here illegally, which it sounds like he is, than yes they will deport him. You should speak to an immigration attorney immediately to see what can be done.
