QUESTION

Will my opt extension get rejected. ?

Asked on Jun 04th, 2018 on Immigration - Tennessee
More details to this question:
I am currently on OPT EAD status I have done Bachelors in Commerce (3 years) from India graduated in 2015 I came to USA in 2016 on student visa and studied Masters in Computer science (2 years) from USA graduated in 2017 December. I have received the initial OPT and I am working in a company. My employer is saying my previous education from india may raise question to USCIS and reject my application for OPT extension and H1b because i have three years bachelors degree that is in Commerce not in computers. Does it really matter to have bachelors degree in different field as far as i have masters degree from USA in computer science and I am also working in the computer science field

Your employer appears to be misinformed as everyone will be looking at your U. S. Masters in computer science rather than your degree from India. Perhaps your employer has been reading many articles in the ethnic newspapers that focus on the difference between India and U. S. bachelor’s degrees. But those would not be relevant in your case where you have a U. S. Masters in the field for which you will be obtaining A STEM extension (provided that your employer is under E-Verify) and applying for a future H-1B petition.
