QUESTION

Will my TPS affect H1B stamping?

Asked on Jun 20th, 2016 on Immigration - Texas
More details to this question:
I was in F1 status and I recently got approved for H1B which will be effective from 1st October , 2016. I am flying to my home country Nepal in October 7 for a month vacation and to return I have to get H1B stamping. I have EAD through a TPS and it is still pending. Will there be a problem to get H1B stamping if I have TPS approved or pending in October.

You should not have any issue if you have maintained your student status. If, however, you have not maintained your student status, you should discuss the matter further with an attorney before departing the country.
