I have a speeding ticket showing in my DMV record from the year 2012. The code assigned was 3362. Did not have any jail, arrest or anything of that sort, just points got added and now they are also gone. This is my first ticket and I do not have any other violations or offense or citations during my 17 year history of living here in the US as a Green card person. Please let me know if this would 1. Be a criminal offense? 2. Be considered a CMT as per immigration? and 3. Be a reason to reject my GC and place me in removal proceedings?
A single speeding ticket or other ordinary traffic ticket should have no impact upon eligibility to renew a Green Card (nor should it have any impact upon a Petition to Remove Conditions or a Petition to become a naturalized citizen). The USCIS will be aware of the traffic ticket from its background check. It should be disclosed on an application asking to identify citations, but not on an application asking for arrests "except traffic offenses." The speeding offense is not a CIMT (crime involving moral turpitude), and it is not an offense that would trigger removal/deportation. Of course, there are many other details relating to immigration eligibilities.
