QUESTION

Will unemployment benefits affect my husband’s petition?

Asked on Jun 04th, 2024 on Immigration - North Carolina
More details to this question:
I (USC) filed for my husband’s adjustment of status in December of 2023 when I was still employed. I recently got laid off and am wondering if applying for unemployment benefits will hurt my case in regards to the Form I-864. So far this year, I’ve earned more than 125% of the poverty amount already and my husband also has a full time job after getting the EAD. My question has two parts: does applying for unemployment benefits hurt our case? And secondly, should we approach a joint sponsor for our case in case I don’t get a new job by our interview?

Unemployment benefits can count towards meeting the minimum level required. If your husband has legal permission to work, his income can also count towards the minimum needed for green card sponsorship.
