Work Visa Holder Under a Disciplinary Action Investigation. Immigration issues?
Asked on Apr 24th, 2018 on Immigration - New Jersey
More details to this question:
I live and work in the US on a work visa and own a company in my home country. I’m not working for the company, I’m the owner. The company service is to provide day-trading related education material and trading signals. I have a personal account in a US-based Exchange and they recently initiated a disciplinary investigation on me and my trading account as the owner of the company. The compliance department sent me very personal questions and wanted me to provide personal information (workplace, bank statements, my current residential addrsss and so on). I don’t feel comfortable to provide it to them. They will probably revoke my exchanges membership. But they also notify the CFTC on any revocation of its members. Will it cause an immigration issue for me as a non-citizen? Or is it a civil matter? I soon want to visit my home country and it got me scared whether I might face any issues on my way back due to this disciplinary action? Thank you
Although no one can give you a guarantee of what direction U. S. law enforcement may take, U. S. immigration laws are generally attuned to criminal and not civil matters. It is more likely that if the investigation turns criminal and you are arrested at some point in the future, the Department of Homeland Security may take an interest, and that could cause an immigration issue. Barring that, the chances are that you will not face an immigration issue on your way back to the country.
