QUESTION

Would I get back my visa that was lost?

Asked on Dec 15th, 2023 on Immigration - Iowa
More details to this question:
I am an international student applying for my visa in December. I had a minor incident where I was accused of theft at Walmart. I hired a lawyer, completed community service, and the case was dismissed upon the motion of the Plaintiff, with costs assessed to the Defendant. I lost my previous visa in 2022, and now, as I reapply, I marked "yes" to the question about arrests or convictions. I provided an explanation detailing the circumstances of my case.

Your incident at Walmart would not make you inadmissible to the United States. That being said, student visas are given in the discretion of American consular officers. A reasonable officer in the absence of other unfavorable factors should give you another visa, but such is not guaranteed as the immigration laws give consular officers much discretion in this area.
