can i sue my stepdaugther for using my insurance

More details to this question:
under one household my wife,stepdaugther, stepson and my self have insurances. but im the only one that have uninsurance motorized on my policy.we all have individual policy. she had it a accident on her friend car and she was the passenger.her friend insurance only have pip and doesn't cover much. my stepdaugther lawyer is using my uninsurance motorized policy to sue the insurance comp. to get the 10,000 dollars. without my concern and/or authorization this is my third claim on 3 years on my policy and for state farm is flag and is on for a increase review and my premiun will go up and i'll be penalize for 3 years becuase of her.she hate me and we dont get alone. she will get all the money while my policy is going up. can someone let me know if i have a case a gain her. thank you.

Unfortunately, if the policy language affords her coverage she has the legal right to make a claim under the policy. If that is the case, you do not have a right to prevent her from doing this. However, most Uninsured Motorist policies do not allow coverage to a resident relative (for example, your stepdaughter) who own their own car. Since you mentioned she has a car, you may want to find out from the insurance company if she lied about that. There are a number of other exclusions all of which I would imagine your company would look into before allowing her coverage under the policy.  I am sorry your insurance premium may go up as a result of this claim, but please do not drop your UM coverage because of it. With the large number of people driving cars without liability coverage, it is a very important protection.
