Can my spouses employer prosecute for insurance fraud when lying on spouse coverage affidavit?

More details to this question:
My spouses employer want us to sign a affidavit stating that if I can get insurance coverage through my current employer I cant get coverage through them. But if I am unemployed or not offered coverage they will allow me to be added. I am offered insurance through my current employer but the benefits are very little and it will cost us 100 dollars more a week to go on my employers plan. I signed a denial for coverage through my employer years ago. How would my husbands employer even know if I am eligible for insurance through my employer? Would they really prosecute for insurance fraud? Isn't that discriminating by allowing spouses that don't work on and those that do can't. Is there any case law on this?

Not sure what you actually question is. However, you can never be forced to sign anything and certainly should never sign something you think would be false or fraudulent.
