QUESTION

Cashing Insurance settlement check for Florida sinkhole?

Asked on Jul 08th, 2013 on Insurance - Florida
More details to this question:
My wife and I owned a rental house in Florida that had a sinkhole. in January of this year, we received a settlement check for the sinkhole that we requested from our insurer. The check is payable to my wife and the lender. We short sold the house "as is" without repairing the sinkhole in March. The lender filed a Satisfaction of Mortgage/Lien with Hernando County. We still have the uncashed insurance settlement check. 1. Will the check expire after a certain time by law? 2. If we request it, should the Insurer reissue a new check with my wife as the only Payee? Or can the Insurer legally issue a stop payment for the check we're holding if alerted that we no longer own the house? 3. If the Insurer is not required to reissue a new check with my wife as sole payee, would the lender be required to sign over the check to my wife?
