QUESTION

Do I have a case?

Asked on Jan 20th, 2017 on Insurance - Florida
More details to this question:
A driver left his vehicle unattended and it rolled in to my parked car. Incident happened July 5th 2016 early morning. The driver's insurance company Progressive, has capped out there 10k max on my repairs and saying that they can't spend anymore money on this issue and that I'm responsible for the rest. The repairs left are from the accident of which I was in my bed sleeping during the accident. Progressive claims that my insurance will have to assist. I have spoken with Gieco in regards to this and there is nothing they can do. I have spent I alot of time dealing with this. They have lied about parts that have been fixed on the vehicle. In which, the manufacturer has verified still an issue with my car as w result of the accident. I have been accused of causing damage to my car because they fixed it and I've had to take my car back to progressive around 7 times in the last 7 months for the same issue. Every time they accuse me of damaging the wheel where the car struck my vehicle.

No idea - this sounds like a blend between a policy limits property damage case and claims that you are doing additional damages yourself. Bottom line is is if the insurance is tapped out and you have no collission coverage - you are stuck unless you think the other driver has money to pay and there was no release signed for the insurance repairs. Generally, if you are forced to sue he other drvier personally, you are not likely to eve see menaingful money.
