QUESTION

Do I have a case for settlement?

Asked on Dec 15th, 2014 on Insurance - Maryland
More details to this question:
I ordered a milkshake from a fast food restaurant and there was a black screw from a machine in my milkshake. It came up through the straw and entered my mouth. At first I thought it was chocolate or something but soon realized it was foreign, and so I spit it out. Contacted the restaurant and corporate immediately. The Insurance company is supposed to call me today or tomorrow. I was curious if I even can do something about this. I was uninjured as I am smart enough to know that whatever was in my mouth was not part of the drink. Due to the screw in the cup, it did puncture the cup and it leaked on me and my car and everything else as well. Anyway, thought to ask. Thank you.

Since you didn't suffer any harm or damages, you likely do not have grounds for any legal action. I wouldn't expect much of anything out of this.  I am glad you are unharmed.  You can continue to talk and work with the insurance company and you may get some small settlement amount, but again, as you were not injured and thus, did not suffer any damages, there is likely not going to be any grounds for a legal disputer or large monetary settlement.  NOTE: This response is general in nature and should not be considered legal advice.  No attorney-client relationship exists or is formed by this response.
