my car was rearended the other driver said he would rather pay for the damages but when i gave him the estimate he said that he had no money.

Did you call for a police officer to make a report at the scene of the collision? Or at least get the other driver's insurance information?
If so, you should open a claim on his insurnace policy for your vehicle repairs. You shoud also open a claim for bodily injury on his policy if you were injured as a result of the collision.
