QUESTION

Can an acquisitions editor give your book concept to a different client?

Asked on Feb 21st, 2023 on Intellectual Property - Michigan
More details to this question:
My former literary agent submitted my manuscript to an editor at a publishing house in 2019. The editor said she was very excited about the pitch but ultimately rejected it. 2 years later a book with an almost identical title and concept, with many of the same jokes, was published by this publishing company. I looked further into it and the acquiring editor was the same one who had rejected my manuscript. There was no word-for-word plagiarism but many, many similarities and the style, tone, and humor are the same. My book is now unpublishable because it will look as if I am copying this book. Is there any legal recourse if the editor lifted elements from my manuscript?

It looks like the publisher stole your idea:  you need to prove the submission and their interest this is a very tough case to win as a budding author myself looking to get published, I definitely understand the anger and pain you must feel regarding this. feel free to be in touch, if I can help, I will.
