QUESTION

Can an attorney help secure a design patent? How?

More details to this question:
I have an idea which I have checked and is unpatented technically and I need to secure a patent on the design before I can begin selling it. I have very little money though so I would like a waiver on the initial fees, making my patent attorney an investor and shareholder.

An attorney is not allowed to become an investor for a client's idea; it creates an ethical conflict. Look for your funds elsewhere. FYI, You will need to pay application and attorney fees up front.

Design Patent Law is complicated - and should be done by an experienced practitioner. Visit the Patent Office website - www.uspto.gov - and check out some design patents and guidelines related to them. It would be unusual for a patent attorney to waive fees and become an investor. Check out the "pro bono" program at the USPTO - you may qualify for free services. GOOD LUCK!

That is not a common arrangement in the beginning stages. You are more likely to get friends/family to invest in that stage.
