Cease and Desist

Hi, I received a Cease and Desist letter in the mail from a lawyers office today. Claiming that my website has infringed on their clients trademark.. (well thats a lie because I never even used this domain name, I just buy and sell them). Secondly they didn't even spell my last name or email correctly on the letter head and on the document itself. They are saying I owe lost revenue to their client.(I again never advertised or sold any products). And if I do not write them a letter with in 5 days , that they will take this to court. BTW they aren't located in my state. What should I do?

Well you need to have the website in question (and your use thereof) evaluated against their trademark claim to determine whether there is any legitmacy to their request to C&D.  Once you have that evaluation, you'll need an attorney to write back a response for you.  Typically that whole process will 4-5 hours to complete.   -Paul http://www.protectitip.com/contact/
