QUESTION

Do trademarks include derivations of words?

Asked on Oct 04th, 2012 on Intellectual Property - Idaho
More details to this question:
If someone has a registered trademark such as "Nuts 'n Bolts", would they be able to ask for a cease and desist a company using "Nuts and Bolts" or "Nuts ampersand Bolts"? where ampersand is the symbol, this site wouldn't let me use that character in this field.

If the goods or services are the same or overlapping such that a likelihood of confusion exists, then sending a cease and desist would be appropriate, while if the fields of use are very different or other factors make confusion unlikely, then sending of a cease and desist would not be appropriate.
