QUESTION

Trademark Questions

Asked on Aug 31st, 2014 on Intellectual Property - New Jersey
More details to this question:
I have a few questions: 1) I have an LLC called Scholarships360 and a corresponding domain called scholarships360.org. I tried to buy scholarships360.com but the person who owns it is squatting on it and wants to charge us thousands upon thousands of dollars. If we file for a federal trademark can we seize the domain? I believe cybersquatting on a trademarked name is illegal. 2) I have the domain admissions360.org and am looking to claim admissions360.com as well as the twitter handle @Admissions360 but it appears that both of them are being squatted on as well. Can these be seized too? 3) How much would all of this cost?

Update Your Profile
Squatting on a domain name with the intent to extort money from someone else who owns the trademark rights has been an issue. You would need to show the domain name holder knew of your registration and purchased the domain to keep it from you until you paid for it. Your situation is clearly different. Based solely on the facts you have described, I don't think you are in a situation to seize any domains or twitter handles. Good luck, Todd
