More details to this question:
I have an idea of creating an online entertainment website. However, I noticed that I have a competitor that's doing the same cup of tea. Now, my competitor bought .com & I own .net plus his Facebook like page is kicking my butt. If I trademark the name is there a chance for me to win and have full rights to the name. FYI, I started my fan page a week before he did and I bought my domain a month before he purchased .com please advise at your earliest convince thank you

As the first user, you would be able to register your trademark despite the competitor's use. However, your competitor likely will fight you on it and while you might be able to ultimately win, your competitor could make it very expensive for you to do so.
